1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

GlowUpFinder is an online directory platform that connects consumers with beauty and aesthetic service providers. We provide a platform for businesses to list their services and for consumers to browse, compare, and review those services. We do not provide beauty services ourselves and are not a party to any transaction between consumers and businesses listed on our platform.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation.
• Submit false, misleading, or fraudulent information, including fake reviews or business listings.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to it.
• Use any automated means, including bots, scrapers, or spiders, to access the Service or collect data without our prior written consent.
• Transmit any viruses, malware, or other harmful code.
• Harass, abuse, or threaten other users of the Service.

4. User Content

Reviews and Ratings

When you submit a review or rating, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute your content in connection with the Service. You represent that your reviews are based on genuine personal experience and are truthful and accurate.

We reserve the right to remove, edit, or refuse to publish any review that we determine, in our sole discretion, violates these Terms, is fraudulent, is abusive or defamatory, or is otherwise inappropriate.

Business Listings

If you submit a business listing, you represent that you are authorized to provide the information included in the listing and that such information is accurate and not misleading. We reserve the right to edit, remove, or decline to publish any listing at our discretion. Business listings submitted through our platform are subject to review and approval before being published.

5. Business Listings and Claims

Businesses listed on GlowUpFinder may be added by our team, by the business owner, or by third parties. We strive to ensure listing information is accurate but do not guarantee the accuracy, completeness, or reliability of any listing.

Business owners may claim their listing through our claim process. Claiming a listing allows the business owner to manage and update their business information. We reserve the right to verify the identity and authorization of anyone attempting to claim a listing and may reject claims at our discretion.

Business listings may be created by our platform using publicly available information from sources including the Google Places API. The inclusion of a business on GlowUpFinder does not imply endorsement, affiliation, or any business relationship between the listed business and TPS Worldwide LLC.

Photos displayed on business listings may be sourced from third-party services and are displayed with appropriate attribution. Photographers and rights holders may request removal of their photos through our DMCA process at glowupfinder.com/dmca.

Business owners who wish to update, correct, or remove their listing may do so by claiming their listing through our claim process or by submitting a removal request at glowupfinder.com/removal. We aim to process removal requests as soon as possible.

GlowUpFinder reserves the right to retain basic business information (name, address, category) for directory completeness even after a removal request, unless required by law to fully remove it. Photos and detailed descriptions will be removed upon valid request.

5a. Paid Subscription Services

GlowUpFinder offers optional paid subscription tiers for business listings: Featured ($9.99/month) and Premium ($19.99/month). Both are billed on a recurring basis until canceled. Pricing and placement benefits are subject to change; any changes will apply at your next billing cycle.

The Featured plan includes a "Featured" badge, top placement on city and category pages, highlighted listing cards in search results, and priority placement in homepage sections. The Premium plan includes all Featured benefits plus a Premium banner on your listing page, the ability to create special offers and coupons, a "Request Appointment" lead generation feature, and a monthly performance report email.

Purchasing a subscription does not guarantee any specific outcome, number of views, clicks, leads, bookings, or revenue. Placements may rotate among participating businesses when more than one listing qualifies for the same slot. We reserve the right to remove or decline subscription status for any listing that violates these Terms or that we determine, in our sole discretion, to be inappropriate for promotion.

Payments are processed by Stripe, Inc. By subscribing, you authorize us (via Stripe) to automatically charge your payment method the applicable monthly fee on the same day of each month until you cancel. Subscriptions renew automatically. If a payment fails, your subscription benefits may be suspended after a grace period, and your listing will revert to a Basic Listing until the issue is resolved.

You may cancel your subscription at any time using the "Manage Subscription" button in your Business Dashboard (which opens the Stripe Customer Portal), or by emailing support@tpsworldwidellc.com. Cancellation stops future billing at the end of the current paid period; your subscription benefits remain active until that date.

All sales are final. We do not provide prorated refunds for partial months, for periods during which your subscription was active but underperformed, or for any other reason, unless a refund is required by law or we determine in our sole discretion that a refund is appropriate. To request a refund under these limited circumstances, email support@tpsworldwidellc.com.

5b. Email Communications and Consent

When you submit a business listing, we will send you a transactional confirmation email regardless of your marketing preferences. This email confirms receipt of your submission and communicates its status, and is considered necessary to deliver the Service you requested.

If you affirmatively opt in by checking the marketing consent box on the submission form, you also agree to receive periodic marketing and promotional emails from GlowUpFinder, which may include information about our Featured Listing service and other paid or free offerings. You can withdraw this consent at any time by clicking the unsubscribe link in any marketing email or by emailing support@tpsworldwidellc.com. Withdrawing marketing consent does not affect transactional emails related to your listing.

5c. User-Submitted Content

By submitting photos, descriptions, or other content to GlowUpFinder, you grant TPS Worldwide LLC a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute the content on our platform. You retain ownership of your content and can remove it at any time through your business dashboard. You represent and warrant that you own the rights to any content you submit, or have obtained all necessary permissions. You agree not to submit content that is obscene, defamatory, infringing on third-party rights, or otherwise objectionable.

5d. Business Owner Accounts

Business owner dashboard access is granted upon approval of a claim request. Access is tied to your email address and the specific listing you claimed. You are responsible for maintaining the accuracy of your listing information. GlowUpFinder reserves the right to revoke dashboard access if your listing is found to violate our Terms of Service or if we determine the claim was made fraudulently.

5e. Photo Policy

Photos submitted by business owners are displayed on listing pages. GlowUpFinder is not responsible for the content of user-submitted photos. If you believe a photo infringes your copyright, please submit a request through our DMCA page at glowupfinder.com/dmca.

6. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are owned by TPS Worldwide LLC and are protected by copyright, trademark, and other intellectual property laws. The GlowUpFinder name, logo, and all related marks are trademarks of TPS Worldwide LLC.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any portion of the Service without our prior written consent, except as permitted by these Terms.

7. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources, including business websites, booking platforms, and social media profiles. These links are provided for your convenience only. We do not endorse and are not responsible for the content, products, or services offered by third parties. Your interactions with third-party services are governed by their own terms and privacy policies.

8. Affiliate Links

GlowUpFinder may include affiliate links to products or services that we believe may be relevant to our audience. If you click an affiliate link and complete a purchase, we may earn a commission from that referral.

Affiliate relationships do not affect the price you pay, and they do not determine which businesses appear in our directory or which products our editorial team recommends. Our editorial content and business listings remain independent of affiliate compensation.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) ANY BUSINESS LISTED ON THE SERVICE WILL PROVIDE SATISFACTORY SERVICES; OR (D) ANY INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT.

We are a directory platform and do not provide, endorse, or guarantee any beauty or aesthetic services. Any appointment, transaction, or interaction between you and a listed business is solely between you and that business.

10. Deals and Promotional Offers

Deals, discounts, promo codes, and other promotional offers displayed on GlowUpFinder are provided by the listed businesses. We may review or verify offers when possible, but we do not guarantee that any promotion is accurate, current, available, or suitable for your needs.

You are responsible for confirming pricing, availability, eligibility requirements, expiration dates, and all other terms directly with the business before booking, purchasing, or relying on any promotion.

11. Blog and Editorial Content

GlowUpFinder may publish blog posts, guides, reviews, city spotlights, and editorial content for informational and entertainment purposes. This content reflects general opinions and commentary and should not be considered medical, legal, financial, or professional advice.

You should consult an appropriate licensed professional before making decisions about cosmetic treatments, skincare products, health-related services, or any beauty service discussed on our platform.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TPS WORLDWIDE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless TPS Worldwide LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit through the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against TPS Worldwide LLC.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

16. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
